These Terms of Service ("Terms") govern your access to and use of the website located at mjcfinancialfitness.com (the "Site"), which is operated by MJC Financial Fitness LLC, a registered investment adviser ("MJCFF," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About MJC Financial Fitness

MJC Financial Fitness LLC is a fee-only investment adviser registered with the State of Illinois. Information about our advisory services, fees, and conflicts of interest is contained in our Form ADV Part 2A and Part 2B, which are available on our Site and through the Investment Adviser Public Disclosure database at adviserinfo.sec.gov.

2. Informational Use Only

The content on the Site is provided for general informational and educational purposes only. Nothing on the Site constitutes:

  • Personalized investment, tax, legal, accounting, or financial planning advice;
  • An offer to sell or a solicitation of an offer to buy any security or service;

Investment advisory services are provided only to clients who have entered into a written investment advisory agreement with MJCFF. The Site does not create an advisory relationship.

9. SMS / Text Messaging

If you opt in to receive text messages from MJCFF, your participation in our messaging program is governed by our SMS Terms, available at mjcfinancialfitness.com/sms-terms.

The Site and all content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Nothing in these Terms is intended to waive or limit any obligation or duty MJCFF owes to its advisory clients under the Investment Advisers Act of 1940, applicable state securities laws, or under any written advisory agreement.

11. Limitation of Liability

To the fullest extent permitted by law, MJCFF and its members, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, even if MJCFF has been advised of the possibility of such damages. This limitation does not apply to liabilities that cannot be limited under applicable law, including any obligation MJCFF owes to its advisory clients in their capacity as clients.

12. Indemnification

You agree to indemnify and hold MJCFF harmless from any claim, loss, or demand, including reasonable attorneys' fees, made by a third party arising out of your breach of these Terms or your misuse of the Site.

13. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" at the top of this page indicates when these Terms were last revised. Your continued use of the Site after we post a revised version constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
